I hate my job. I will not deny that fact. I am done and ready to move on. Just a few more months and I'll be home free. Til then, it pays my bills and could be so much worse. However, on days like today- I smile and enjoy what I do. Why? Because I get to rub someones face in shit. Let me elaborate...
We have a client. He is from France and is married to an American woman. She handles the finances and such. He was out of work for however many months and had to file bankruptcy. Before that, his spouse tried to settle debts with a debt settlement agency. It was her idea,she funded the operation (as he was out of work) and it didn't go quite as planned. As a result, the agency refunded her payments to her,depositing them in their joint account. We were aware of this information when filed, and just as a precaution, exempted $500.00 of the $1,900.00 that was due even though she did not file and it was not HIS money. Well the Trustee for this case latches onto this for whatever reason. Probably in part because his paralegal doesn't care for neither me nor my boss because we have been through this before and 'won', if you will. Today we get the following letter:
Lovely. Especially since we emailed these people proof that the debt settlement money belongs to the debtor's wife. And the tax refund? I think not. The Trustee is not entitled to a tax refund unless a case is filed after the first of the year, technically. We start exempting refunds towards the end of November just to be safe. However, this case was filed in AUGUST of 2008, therefore we had no need to exempt the refund. They are just asking for it because it is now tax time and they are assholes- happened before with this Trustee/staff. Now, as for the personal property that is non-exempt, we do not have to exempt personal property that is owned JOINTLY. There is no need. They can't take your shit from your spouse. The end. To 'rectify' this issue, I just filed the appropriate amended schedules and showed 1/2 of the interest in all personal property exempt- since that is our debtor's share. If you wanna be a jerk, I'll be a jerk back. Along with a copy of said schedules, I have this letter:
